End-of-Life Notice
The EaseAir Smart Indoor Air Quality Monitor has reached End of Life (EOL). The website at https://easeair.com (the "Site") and the EaseAir companion application (the "App", together with the Site, the "Services") are maintained only as an informational and post-sales support portal for existing customers. No new purchases, subscriptions, or orders are processed through the Services; any residual purchase-related UI elements are non-functional. These Terms of Use (the "Terms") govern your use of the Services during this wind-down. Please read them carefully. If you do not agree, do not use the Services.
Nothing in these Terms limits or excludes rights you have under mandatory consumer-protection law that cannot be waived by agreement.
1. Who You Are Contracting With
The Services are provided by MAKEX GLOBAL GROUP PTE. LTD., a company incorporated in the Republic of Singapore with registered address at 7500A Beach Road, #04-307 The Plaza, Singapore 199591 ("EaseAir", "we", "us", or "our"). Contact: [email protected].
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to accept these Terms on your own behalf. Users aged 13 to 17 may use the Services only with a parent's or legal guardian's consent and supervision; in certain EEA Member States the minimum age is 16 (Article 8 GDPR). The Services are not directed to children under 13.
3. Services Scope (EOL Status)
Because the product is EOL, the Services are limited to: (a) product documentation, safety notices, and EOL announcements; (b) warranty, return, refund, and repair-shipment support for legacy customers; (c) account login to retrieve order, warranty, or historical device data; and (d) security advisories. No new orders. Any "Buy", "Subscribe", "Add to Cart", or pricing elements that remain visible are non-operational and do not constitute an offer.
4. Your Account
If you retain a legacy EaseAir account, you are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account. Please notify [email protected] promptly of any unauthorized use. You may request account closure at any time, subject to records we must retain under applicable law (see the Privacy Policy).
5. Acceptable Use
You agree not to:
- use the Services in violation of applicable law or these Terms, or to infringe the rights of others;
- attempt to gain unauthorized access to, probe, scan, or disrupt the Services, related systems, or other users' accounts;
- use automated means (scrapers, bots) to extract data from the Services beyond what a normal browser would do, or circumvent any rate-limits or security measures;
- reverse-engineer, decompile, or tamper with the App or any firmware except to the minimum extent permitted by mandatory law (including interoperability rights);
- upload malware or content that is unlawful, defamatory, obscene, or that violates others' intellectual-property, privacy, or publicity rights.
6. Intellectual Property
The Services, including all text, graphics, software, trademarks, and logos, are owned by EaseAir or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their stated post-sales purpose. All rights not expressly granted are reserved. "EaseAir" and associated marks are our trademarks; do not use them without our written permission.
7. User Submissions
If you submit content to us (for example, warranty correspondence, feedback, or troubleshooting photos), you retain ownership of your content. You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and process that content solely to provide the Services (including support) and to comply with law. You represent that you have the right to submit the content and that it does not violate these Terms. We may remove content that we believe in good faith violates these Terms or applicable law.
8. Legacy Warranty, Returns, and Refunds
For units purchased while the product was on sale, we continue to honor the published limited warranty and any statutory rights you have as a consumer (including, in the EU / UK, rights under Directive (EU) 2019/771 and implementing laws, and in Singapore under the Consumer Protection (Fair Trading) Act and the Lemon Law provisions of the Sale of Goods Act). Statutory consumer rights are not affected by these Terms. To initiate a claim, email [email protected] with your order number or product serial number and proof of purchase; we will respond in line with applicable law.
9. Software and Service Wind-Down
Because the product is EOL, we may modify, suspend, or discontinue features of the App or Site at any time, with reasonable advance notice where feasible and required by law. We will continue to provide security-relevant updates on a commercially reasonable basis during the wind-down. Cloud-dependent features may become unavailable upon final decommissioning. We will post a final decommissioning notice on the Site in advance.
10. Third-Party Services
The Services rely on third-party providers (including Cloudflare for hosting, CDN, and security; PayPal for legacy payment records; and, where analytics is consented to in the EEA / UK, Google Analytics via Google Tag Manager). Your use of those providers' services may be subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third parties beyond our reasonable control.
11. Disclaimers and Limitation of Liability
Disclaimers. To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any particular information is accurate or current. The EaseAir device is a consumer indoor air quality monitor and is not a medical, safety, or life-support device; do not rely on it in life-threatening situations.
Limitation of Liability. To the maximum extent permitted by applicable law, EaseAir and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Services or these Terms. Our aggregate liability for any claim arising out of or relating to the Services or these Terms shall not exceed one hundred US dollars (USD 100) or the amount you paid us for the product in the twelve (12) months before the event giving rise to the claim, whichever is greater.
Consumer carve-outs. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including: (a) liability for death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) liability under Council Directive 85/374/EEC (as amended and as recast in Directive (EU) 2024/2853) for defective products; and (d) any non-waivable statutory rights of consumers under the laws of the EEA, the United Kingdom, Singapore, California, or your country of habitual residence.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or upon final decommissioning of the Services. Sections that by their nature should survive termination (including Intellectual Property, User Submissions license, Disclaimers, Limitation of Liability, Governing Law, and Miscellaneous) will survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Singapore, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. Subject to the paragraphs below, the courts of Singapore shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
Consumers in the EEA and the UK. If you are a consumer habitually resident in the EEA or the UK, (a) you also have the benefit of any mandatory provisions of the consumer-protection law of your country of residence; (b) under the Brussels I Recast Regulation (EU) No 1215/2012 (Articles 17–19) and equivalent UK rules, you may bring proceedings against us in the courts of your country of residence, and we will only bring proceedings against you in those same courts;
Consumers in California and other U.S. jurisdictions retain any non-waivable rights under the law of their state of residence, including small-claims-court rights.
14. Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and EaseAir regarding the Services and supersede any prior agreements on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be posted on the Site or sent to the email on file; notices to us should be sent to [email protected]. These Terms are published in English; translations (such as the Chinese version) are provided for convenience, and in case of conflict the English version prevails, except where mandatory consumer-protection law of your jurisdiction requires otherwise.
15. Changes and Contact
We may update these Terms to reflect changes in our practices, the EOL wind-down, or applicable law. Material changes will be posted on the Site and, where required by law, notified by email. Continued use of the Services after an update constitutes acceptance, to the extent permitted by law.
